Official Rules for the Birkenstock Holiday Promotion Supporting Soles4Souls

NO PURCHASE NECESSARY

1. Contest Overview. To enter the Birkenstock Holiday Promotion Supporting Soles4Souls (herein, the “Contest”), sponsored by Birkenstock USA, LP (herein, “Birkenstock”, “us”, “we” or “our”), you (herein “You” or “Contest Entrant”) must fill out and submit the contest entry form found at your Birkenstock retailer’s store or on the Birkenstock webpage (both herein referred to as the “Entry Form”), located on the Internet at URL: http://www.birkenstockandsoles4souls.org/contest. All contest entries are subject to the Official Consumer Contest Rules, which can be viewed on the Internet at URL: http://www.birkenstockandsoles4souls.org/rules.  Your Contest Entry must be submitted from and after 12:01 am PST on November 16, 2009 through midnight PST on January 5, 2010. No purchase or donation is required to enter. Purchases or donations will not increase your chance of winning. Further restrictions apply, as set forth below.

2. How to Enter. You must enter the following information on the Entry Form to enter the Contest: 1. your name; 2. a valid Email address that is your own Email address; and 3. your valid mailing address. Entering the same name, address or Email address more than once does not increase your chance of winning, since each person can only enter once and it wastes your time. Contest entries become the property of Birkenstock USA, LP. (“Birkenstock USA” also referred to as “we” or “us”). Any submission that is deemed inappropriate, indecent, obscene or otherwise does not comply with these Contest Rules, as determined by us in our sole discretion, shall not be eligible to win.

3. Mailing List. Entrants will receive Email announcements and special offers from us, but you can always decide to opt-out of emails later by visiting our website at URL: http://www.birkenstockusa.com/newsletter_signups and following the instructions listed there. The contest will run once. The promotion end date is January 5, 2010 at midnight PST. We reserve the right to change or cancel the promotion at any time, at our sole discretion.

4. Your Privacy. The personal information submitted to us in your entry form will be handled by us in accordance with our Privacy Policy, which you can view on the Internet at the following address: http://www.birkenstockusa.com/privacy-policy, except as otherwise set forth in these Contest Rules. By submitting your Contest Entry, you agree that we can send you Emails as indicated above. Accepting the prize grants to both Soles4Souls and us express permission to use the winner's name, city, state, and likeness for promotional purposes without compensation or notice except as provided herein to the extent permitted by law.

5. Drawings. On or about February 26, 2010, we will conduct a random drawing from all eligible entries and select one winner of this Consumer Contest. We will announce the winner as soon as commercially reasonable thereafter. Our decisions are final. Your odds of winning depend on the number of eligible entries we receive. We notify the potential winners by Email. If the Email address is invalid or the notification cannot be delivered for any reason, we will select another winner at random. If a dispute arises over entitlement to a prize, the winner is the person to whom the Email account was assigned by the appropriate agency, internet service provider, business, or organization. Each Email address may win only once.

6. Prizes. There will be one (1) winner who will receive a trip for two (2) to accompany a Soles4Souls donation team and distribute shoes. The prize is awarded to the winner, courtesy of Soles4Souls and their corporate donors. The winner may choose their companion who will accompany them on the trip, so long as the chosen companion is over

the age of 18 and is able to, and in fact does obtain any passports and visa as may be required for the trip at least 30 days prior to the departure date announced by Soles4Souls. The winner will likewise be responsible for having or obtaining, at winner’s own expense, any passports d visas as required for the trip at least 30 days prior to the departure date announced by Soles4Souls. This prize trip will be to an international location and cover all trip costs, including transportation and lodging (but not incidentals, the costs of which will be the responsibility of the winner). Winners are responsible for paying all income and other taxes associated with the prize, if any. The prize consists only of the items that are specifically listed as being part of the prize, and any item, features, cost or expense not specifically listed as part of the prize is the sole responsibility of the winner. No cash alternative to the prize described in these rules is available. The winner will not have any input into or choice of travel destination awarded to them, which shall be determined by Soles4Souls in its sole discretion. If the winner does not wish to travel to the destination selected by Soles4Souls, the winner shall not be permitted to select a different destination. Any winner and their chosen companion must also fulfill any and all requirements imposed by Soles4Souls for travel with their donation team, including, but not limited to, execution of their Trip Registration form, as set forth at http://www.soles4souls.org/pdf/TripRegistration.pdf as it may be amended from time to time. Sponsor reserves the right to substitute any listed prize with a different prize if the prize described here becomes unavailable for any reason. Any prize awarded is not transferrable.

7. General Rules. Open only to legal U.S. residents 18 years of age or older on the date of entry. Our employees and their immediate family members are not eligible. Void where prohibited by law. By participating, entrants hereby waive and release, and agree to indemnify and hold harmless Birkenstock and Soles4Souls, and each of their respective parents, subsidiaries, affiliates, owners, agents, representatives, attorneys, officers, directors and  employees from any and all claims, causes of action, negligence, liability, injury, loss, or damage of any kind relating to, arising from or in any way resulting from entry, participation, acceptance of prize, or redemption of any prize. We are not responsible for typographical errors and for misdirected or incomplete entries. We are not responsible for problems with telephone lines, computer systems or equipment, failure of email, or problems with the Internet or your connection to it. If in our sole discretion we find actual or suspected tampering with the promotion, or automated entries, or technical difficulties that affect an entry or the promotion, we reserve the right to void any entries and/or to change the promotion. Hardware problems, software problems, network difficulties, or events beyond our control may affect the fairness of the promotion or our ability to conduct the promotion, in which case we reserve the right in our sole discretion to cancel, suspend, or change the promotion. All disputes arising from or relating to this contest in any way shall be determined under the laws of the State of California, without respect to any conflict of law issues, and shall be resolved individually, without resort to any form of class action and exclusively by the courts located in Marin County, California (if in state court) or San Francisco, California (if in Federal court). Entry into the contest waives all objections to jurisdiction and venue and constitutes submission to the jurisdiction and venue set forth herein.

9. Contest Sponsor and Administrator. Birkenstock USA, LP of 6 Hamilton Landing, Suite 250, Novato CA 94949, is the sponsor and the administrator of the contest described herein. We reserve the right to change or cancel the promotion at any time.
